(Objective) The objective of this agreement is to stipulate the condition and process of use and general requirements in providing the services (referred to as ‘Service’ hereinafter) related to each following items according to the Law of Electronic Communication Business, Promotion of Use of Information Communication Network, and Protection of Information. 1. Services provided by the Yoon, Eun-Hye Management Agency & Formal Fan Club (referred to as ‘Company’ or ‘Fan Club’) 2. A set of other Services provided through the autonomous development of the Company and Fan Club or cooperation agreement with other companies. Clause 2. (Notification and Effectiveness of the Agreement, Change of Agreement) ① The content of this agreement is effective through the member notification online or other means. ② The Company can make the change of this agreement without any preliminary notification in case of occurrence of rational cause. ③ When the member does not agree upon the changed agreement, he/she could request for withdrawal. In case the member continues to use the Service after the day of effectiveness of the changed agreement, it is considered to be agreed on the changed agreement. Clause 3. (Observations Other than the Agreement) ① Items not indicated on this agreement follow the Standard Law of Electronic Communication, Law of Electronic Communication Business, Promotion of Use of Information Communication Network, and Protection of Information and other related laws and business policies. ② The Company could make the detailed items on the individual services and the content is notified through the user’s guide of the related service. Clause 4. (Definition of Terms) The definition of terms used in this agreement is as below. ① Member: The person who concluded the service use contract by being provided with user’s ID and password through agreeing on the agreement of the Company. ② Join: The person, who wishes to be a member, agrees upon this agreement, submits the required information on the service use application form, subscribes the service use contract and gets the approval from the Company. ③ Identity (ID): In case the person who joined as the member of the Company wishes to use the service, it is an original name of the member that is fixed as the combination of text or numbers for the confirmation of identity of the members. ④ Password: The combination information of text and numbers that is fixed by the member and shared with the company to ensure the identity of the member in service use application using the ID. ⑤ Operator: A person selected by the Company for general management and fluent operation of the service ⑥ Withdrawal: Termination of service use contract due to the expiration or other general issues ⑦ In the special agreement and policy of use for individual services, there could be separate items not defined in this agreement. ⑧ The formal homepages of Yoon, Eun-Hye are www.neri-1003.com and http://cafe.daum.net/yeh84103 and these are operated by the board of Fan Club operators under the support of Yoon, Eun-Hye and the management agency. Chapter 2. Contract of Use of the Service Clause 5. (Completion of Contract of Use) ① For the members to apply for the joining of the Service, the agreement should be read first and agreed upon. By pressing the “Agreed” button online, it is considered to agree upon this agreement. ② The contract of use of Service is completed when the actual information of the applicant is applied to the company and the Company reviews and approves this application and the Company may conduct the real name confirmation process. ③ However, the users under the age of 14 can only use the Service after completion of agreement process of the separate legal representative other than the joining forms stipulated by the Company according to the related laws. ④ In case of wishing to join as a company member, the confirmation process of the company on the content of contract of use application is available. ⑤ The Company may deny or cancel the joining on the application of use related to the below items and the users who didn’t register using their real names cannot demand the set of rights. 1. When he/she used the information of others such as name and residence registration number 2. When the content of the use of service application is false 3. In case of conducting misbehaviors that damaged the well-being, order and morals of the company in using this service 4. In case of disturbing other people from use of this Service or abusing the information 5. In case of violating Standard Law of Electronic Communication, Law of Electronic Business, Consultation Policy of Board of Information Communication Ethics, Information Communication Moral Code, Protection Law of Programs and other related laws and agreement. 6. When he/she has past examples of being denied of the Service from the companies providing other services or has imposed upon the criminal charges related to the item 5. 7. In case lacking the information on the application stipulated by the Company 8. In use of Services for pursue of profits or illegal means 9. In case of application with violation of general stipulated items ⑥ The Company many delay the approval process until the nullification of the cause for the applications related to each following item. 1. When there is no space available within the Service related facilities 2. In case there is a technical hindrance Clause 6. (Private Information Protection Policy) ① The Company makes necessary management for the member private information protection stipulated by the related laws and notifies the related contents on the related private information protection policy of the Company, and for the protection and use of private information, the private information protection policy of the Company and related law is applied. Furthermore, the Company does not bear any responsibilities on the information exposed by the user imputed causes. ② The company can use the information of the members for the purpose of providing more diverse information services such as community services and related benefits. Moreover, the Company should notify and get consent from the members in case of providing member information such as cooperating company, purpose and member information to the cooperating company. When the member does not wish to provide the private information to the cooperating company or allow the Company to use the private information of the member, each member does not have to use the specific services or participate on the promotion and event of specific types and reject the unwanted services through emails at any time. ③ The Company can make a group statistical information on all or part of the members related to the business of the company. Furthermore, the company can send the coolies on the company in providing the service. In this case, the member could modify the setup of the browser of the company to use a caution message for reception or reject the reception of the cookies. ④ The subscription of member information on the application and act of apply for the use according to this agreement is considered to be agreed upon the collection, use and provision of the member information written on the application of use according to the this agreement. ⑤ The member can make change and delete the private information at any time from the private information management of the Service for protection and management of the private information. In case the member requests the cancellation of consent on the collection, use and provision of private information through the means of visitation, letters, telephone, emails, and e-signature or using the member ID, the Company makes necessary measures without delay such as destroying the private information of the relevant user unless the law stipulates otherwise after the confirmation of identity. The company notifies the users in case of destroying the private information of the user without delay. ⑥ When the member requests the perusal or correction of his/her own private information through the means of visitation, letters, telephone, emails, and e-signature or using the member ID, the Company makes necessary measures after confirmation of identity without delay. The Company makes confirmation on the true representative of the member in case a representative makes a visit and requests the perusal or correction. In this case, the Company can demand the provision of proofs showing the representation. ⑦ Once the provided purpose or collection purpose is achieved, the relating private information should be destroyed immediately. However, in case it is related to items below, it is treated as an exception. 1. In case, it is necessary to protect the private information under the laws such as the business law 2. In case of preliminary notification or indication on the period of possession to the user or individual consent from the user 3. 30 days before the withdrawal of the member Chapter 3. Obligation of the Contracting Party Clause 7. (Obligation of the Company) ① The Company will make consistent effort to provide constant and stable service as stipulated in this agreement and in case of technical difficulties, it will do best for restoration and repair. However, in occurrence of unavoidable situations such as natural disaster and emergencies, it can discontinue the Service temporarily. ② The Company will not disclose or distribute the member’s private information provided related to the Service to the third party without the consent of the member. However, it is exempt in following items. 1. In case of the request by the national organizations under the restrictions on the laws such as Standard Law of Electronic Communication. 2. On purpose of criminal investigation for the crime or request of the information communication ethics commission and requests under the procedures underlined on other related laws. ③ The Company should take immediate measures in case the opinion or complaints imposed by the member are judged to be fair. However, if it is impossible to take an immediate action, the Company should notice the member on the ground and schedule. Clause 8. (Obligations of the Member) ① The member has the obligation to manage their own ID and password and all the consequences generated from the member’s imputation are the responsibility of the member. Also, in case of recognizing a third party using the ID, the member should notify the Company immediately and follow the guidance of the Company. ② The member should not conduct behaviors on each item using the Service. 1. Abuse of other member’s ID, password, and residence registration number. 2. Reproducing the information from the Service on other purposes than using the service without the approval of the Company and using this for publication and broadcasting or providing it to the third party 3. Abuse of copyrights and rights of the Company and other people 4. Distribution of information, sentence and graphics which violates the public orders and social morals or create the difficulties on the information communication network. 5. Conduct directly and indirectly related to crime 6. Conduct that is violation of other laws 7. Subscription of false content in member registration or information changes 8. Impersonation of operation board, employee or related personnel of the Company 9. Collection and saving of the private information of other users without the approval of the Company ③ The member cannot conduct the business activities using the Service without approval of the Company and for the result that is generated through the business action and actions in violation of this agreement; the Company bears no responsibility it. The member should make compensation for the damages of the Company for these business actions. ④ The member cannot assign or present the right of use, and other contracted status for use of the Service unless there is a written consent from the Company and cannot provide this as a guarantee. ⑤ The member can perusal and correct the private information through private information management at any time. In case of changes in subscribed items in registration, the member should make changes immediately online or using other means and for the problems generated by not making appropriate changes, the Company bears no responsibility. Chapter 4. Use of the Service Clause 9. (Scope of Use of the Service) The member can use the Service with the ID issued in member application through the Company. Clause 10. (Provision of Information) The Company can provide the information that is recognized that it is critical to notice the member or change of business policies using the notice on the service or emails. Clause 11. (Fee and Chargeable Information, etc.) The Service provided by the Company is free of charge basically. However, in case of separate chargeable information and service, it is only available after paying the noted fees for the related information and services. Clause 12. (Use of Chargeable Information and Chargeable Extra Services) In order to use the chargeable information and chargeable extra services, the paying information should be subscribed on the telephone or online. ① Name of the payee ② Residence registration number ③ Address for receiving receipts ④ Method of payment and other items ⑤ Telephone number Clause 13. (Postings of the Members and Use of Community) The Company operates various community services and bulletin boards for the members to post their own opinions and share common interests. When it is judged that the content posted on the community service bulletin board or registered in the service belongs to the items below, the Company can delete and move the related contents, refuse registration, or restrict the use of the user. ① Contents that abuse other members of the third party or defames the character with wrong information. ② Distribution or linking the contents that violates the public order and social morals ③ Contents recognized to be related to criminal actions ④ Violation of rights such as copyrights of the Company and others ⑤ Expiration of posting period stipulated by the Company ⑥ Linking to the member’s homepage or bulletin board ⑦ Postings that does not correspond to the characteristics of the bulletin board ⑧ Violation of other related laws Clause 14. (Copyright of the Posting) The right for the information posted on the Service is as items below. ① Responsibility and right for the posting is on the person who posted it. However, the Company has the right to process and edit the postings generated by using the joins services also having the right to post within the Service for above postings and the member who posted the related postings is considered to be agreed. ② The member cannot use the information posted on the service for commercial purposes such as process or selling. ③ Yoon, Eun-Hye related pictures and all the information is copyrighted to Yoon, Eun-Hye and Yoon, Eun-Hye Management Agency and temporary use of pictures and postings of Yoon, Eun-Hye or use for commercial purposes, it is violation of the copyright law and objected for punishment. Clause 15. (Duration of Use of Services) ① The duration of use of services is principally 24 hours a day open throughout the year unless there are no operational or technical difficulties. ② When the Company intends to discontinue the Service due to the avoidable reasons such as regular inspections, it should notice the reason and time for discontinuance of Service in advance. Clause 16. (Responsibility of Use of Service) The member cannot make any business actions using the Service in the exception of formal written consent from the Company. Especially, it cannot make illegal conducts such as hacking, money making advertisement, commercial conduct through obscene sites and illegal distribution of common S/W. The result and damage generated by the violation of the member, the member takes the whole responsibility for the legal actions by the related organization. Clause 17. (Discontinuance of the Provision of Services) ① The Company can discontinue providing the Service in case of items below. 1. In case of unavoidable repairs such as service facility repair 2. Discontinuance of electronic communication service by the infrastructure communication business stipulated on the Law of Electronic Communication Business 3. In case of other unavoidable reasons ② The Company can limit or stop the entire or part of the Service in case of difficulty in provision of Services due to unavoidable reasons such as national emergency, black-out, difficulty in service facilities or overcrowding of the use of the Service. The Company will not take responsibility for the deletion of information, transfer failure or loss of other communication data. ③ In case the company limits or discontinues the use of Service by the stipulations in Item 1 and 2, it should notify the members of the causes and limitation duration in advance. ④ In case the user violates the content of this agreement, the Company can limit the use of Services of the relevant user without separate notice. In this case, the Company can ban the connection of the relevant member and can delete the ID and entire or part of the postings. Also, in case of inactivity of the member for more than 3 months, the Company can discontinue the use of Service with one week of notice after announcing by mail or notice. ⑤ The Company can advice the member when it is necessary to change or delete the ID and other information under the rate of use, objective of using this service or other general issues. In case the member does not impose any objections, the Company can change or delete above issues. Chapter 5. Cancellation of Contract and Limitation of Use Clause 18. (Cancellation of Contract) ① When the member intends to cancel this agreement, the member should make the cancellation application online or other means. ② When the member made a conduct related to the items below, the Company can make cancellation of the agreement or discontinue the service for a certain period without notice. 1. Illegal use of service ID and password of other members 2. Intentional disturbance of the operation of Service 3. Using names other than the legal name] 4. Dual registration, one use using two different ID’s 5. Intentional distribution of the contents against the public order and social morals 6. Planning or operating the use of Service on purpose of violating national good or social welfare 7. Conduct of damaging other people’s honor or giving disadvantages 8. Transmission of advertisement information in opposition to intention of other members 9. Distribution of computer virus program that causes destruction, change, and other difficulties of information communication equipment or information 10. Violation of intellectual property rights of the Company and others 11. In case of getting correction request such as deletion from external organizations such as information communication moral committee or receiving authoritative interpretation for illegal election campaign from the election management committee 12. Illegal use of private information, user’s ID and password of others 13. Copy, distribution or commercial use of the information obtained using the Service information of the Company without consent 14. Linking to the sites with the illegal contents through the bulletin board or posting illegal contents 15. Violation of condition of use stipulated by the Company including this agreement Chapter 6. Compensation for Damage and Other Items Clause 19. (Compensation for Damage) The Company does not bear any responsibilities for the damages for one member that is not due to the intentional or critical mistakes of the Company for the use of Service provided without charge. In case of chargeable services, it follows the separate stipulations. Clause 20 (Items of Exemption of Responsibility) ① In case of difficulty of providing service due to the natural disaster or unavoidable circumstances, the responsibility of providing the Service is exempt ② The Company has no responsibility on the difficulties of use of Service caused by the member imputed cause ③ There could be inaccuracy or error in printing in all the information, software, and products provided by the Service. The Company bears no responsibilities to the accuracy of provided information. ④ The Company does not have responsibility to any document or consultation content provided through the Service and loss of expected profit by using this Service. Therefore, if the member whishes to make necessary decisions on the legal, medical or other financial issues, he/she must consult with the professionals in advance. ⑤ The Company is not responsible for the reliability and accuracy on the posted information, data and facts posted by the member. ⑥ The Company has no obligations to intervene on the conflict generated between the user to user and user to the third party and takes no responsibility to compensate for the damage. Chapter 7. Special Stipulations for Children Clause 21. (Private Information Collection of Children etc.) ① If the company intends to collect , provide, or use the information beyond the written range on this agreement of the private information of the child under 14 years of age, the Company should get the consent from the legal representative of the child. ② The Company can request minimum necessary information such as name and contact of the legal representative to get the consent for the stipulation of Item 1.In this case, the Company should notify the child of the items below in simple expressions that could be easily understood by the child. 1. Purpose of collection, use or provision of private information 2. Reason for requiring the consent from the legal representative ③ The Company does not use or provide information to the third party for purposes other than confirming the consent of the related legal representative under the stipulations on the Item 2. ④ The Company makes necessary rational effort to confirm the identity of the child under the age of 14. Clause 22. (Method of Notification and Agreement for the Legal Representative) ① In case the Company intend to get the consent of the legal representative according to the stipulations on the Clause 21, Item 1, the Company should notify the below items to the legal representative. 1. Collection of private information of the child 2. Use or provision of private information to the third party beyond the range notified or written on the Clause 6, Item 2 ② The notification according to the Item 1 follows the method of 1 of the each Item 1. Telephone, fax or mail 2. Subscription of notification on the internet homepage to the legal representative 3. Linking (hyperlink) of private information protection plan on the internet homepage through email 4. Rational means make the notification to reach to the legal representative ③ Agreement on the stipulations on Item 1 is based on the method on the 1 of each Item 1. Using e-signed email of the legal representative 2. Conveyance of the mail and fax with the signature of the legal representative on the form of document provided though downloading or mail 3. Rational means to confirm the true agreement of the legal representative. Clause 23. (Management of the Rights of the Legal Representative) ① The legal representative can cancel the agreement under the stipulations of Clause 21, Item 1 and request perusal and correction of errors on the private information provided by the relevant child ② The stipulation of Clause 6, Item 8 applies to the stipulations of the Item 1 in cancellation, perusal or change of errors by the legal representative. Chapter 8. Others Clause 24. (Management of Difficulties) The Company collect member’s opinions related to private information through the document, email or internet homepage and register the complaints to take actions. Clause 25. (Solution of Conflict and Competent Court) ① The Company and the member can apply for the mediation of conflict to the private information dispute mediation committee for efficient and fast solution in case of conflict on private information. ② In case of law suits on the conflict cause by the use of Service, the court that is in jurisdiction of the location of the main quarter is appointed as the competent court. (Additional Clause) (Date of Validity) This agreement is valid after Oct. 2007. I have read and understand the Member Agreement.
